Gifting an apartment in Armenia: procedure, costs and when it beats a sale
How do you gift an apartment in Armenia?
In short: a gift is the second most common way to transfer property after a sale, especially within a family, and it takes three steps. First, documents: the title documents for the property, a Cadastre extract, the parties' passports, the spouse's consent if needed and permission from the guardianship authority if minors are involved. Then the deed of gift is certified by a notary, with both parties present in person or acting through representatives under a notarized power of attorney. Finally, the transfer is registered with the Cadastre: ownership passes at the moment of registration, not at signing, and this is a key point. On the tax side, a gift between close relatives has traditionally been the gentlest option; between people who are not close relatives the consequences are different and should be checked for the specific case. A gift is more convenient than a sale when property is passed on within a family without payment and when you want to simplify a future inheritance.
Procedure
- Preparing documents: title documents, a Cadastre extract, the parties' passports, the spouse's consent where required and permission from the guardianship authority if minors are involved.
- Notarization of the deed of gift. Both parties attend in person or act through representatives under a notarized power of attorney.
- Registration of the transfer with the Cadastre (how registration works). Ownership passes from the moment of registration, not from signing the deed.
The tax side
A gift between close relatives has traditionally been the gentlest option in terms of tax. Between people who are not close relatives, the tax consequences are different and need to be checked for the specific situation with a notary or tax adviser.
The general rules on taxes and property transactions are covered in property taxes in Armenia.
When a gift is more convenient than a sale
- Transfers within a family without payment, which is what this contract is for.
- Simplifying a future inheritance: the property is passed on during your lifetime, which removes some questions between heirs.
- Allocating a share to a specific family member.
Risks to know about
1. A gift is irrevocable. Unlike a will, which can be changed at any time, a gifted apartment stops being yours as soon as the transfer is registered. A gift can be cancelled only in limited cases set by law and through a court.
2. The donor loses control. The new owner may sell, gift or mortgage the property. If the donor expects to keep living there, that right has to be agreed separately and secured legally, not left as a verbal promise.
3. Sham transactions. A gift that disguises an actual sale (to avoid taxes or to bypass co-owners' pre-emptive rights) can be challenged. This is a risk for both parties, and the "buyer" in such a deal is poorly protected.
4. Debts and encumbrances. The recipient takes the property with its history: arrears in property tax, utility bills and unapproved alterations.
What to check before a gift
- Is the donor's ownership properly registered?
- Are there encumbrances, liens or arrests on the property?
- Is the spouse's consent required?
- Are there minors among the owners or residents?
- Are all debts paid?
This is the same set of checks as when buying: see how to check an apartment before buying.
Gift or will
| Gift | Will | |
|---|---|---|
| When ownership passes | right after registration | after death |
| Can you change your mind | practically no | yes, at any time |
| Donor's control | lost | kept for life |
| Formalities | notary + Cadastre | notary |
The choice depends on whether you are ready to give up control over the property during your lifetime.

Frequently asked questions
Can a gift of an apartment be cancelled in Armenia?
Practically no: a gifted apartment stops being yours right after registration. A gift can be cancelled only in limited cases set by law and through a court, unlike a will, which can be changed at any time.
How does gifting an apartment differ from a will in Armenia?
With a gift, ownership passes immediately after registration and the donor loses control; it is done through a notary and the Cadastre. A will takes effect after death, can be changed at any time, and control is kept for life.
Does the donor keep the right to live in the gifted apartment?
Not automatically: the new owner may sell, gift or mortgage the property. The donor's right of residence must be agreed separately and secured legally, not left as a verbal agreement.
Why is it risky to disguise a sale as a gift?
Such a sham gift, used to avoid taxes or bypass co-owners' pre-emptive rights, can be challenged in court. The buyer in such a deal is poorly protected.
