Apartment alterations in Yerevan: what is allowed, what is not and how to legalize them

Do you need to legalize apartment alterations in Yerevan?

In short: yes, and the problem tends to surface exactly at the moment of a deal. Unapproved alterations cause three concrete problems. They block a mortgage: the bank values the apartment by its documents, and a mismatch between the actual layout and the Cadastre plan is a reason to refuse. They complicate a sale: the buyer either asks for a discount or walks away. And they get in the way of inheritance and gifts, because they come up during registration. Add the risk to the building's structure if the work touched load-bearing elements. Approval is usually needed for moving or removing walls and partitions, changing door and window openings (especially in load-bearing walls), moving the bathroom or kitchen with their wet zones, changes to heating, ventilation and sewage, merging rooms (including joining a balcony to a room) and work affecting the facade. Cosmetic repairs need no approval: finishing, new floor coverings, windows in the same openings, plumbing in the same places.

The topic seems technical until you try to sell. Then it turns out that a wall removed twenty years ago costs time and money.

Why it matters

Unapproved alterations create three concrete problems:

  • They block a mortgage. The bank values the apartment by its documents; a mismatch between the actual layout and the Cadastre plan is grounds for refusal.
  • They complicate a sale. The buyer either asks for a discount or leaves. How this affects the price: how to determine an apartment's real price.
  • They get in the way of inheritance and gifts, because they surface during registration.

On top of that, there is a risk to the building if load-bearing elements were affected.

What usually requires approval

  • Moving or removing walls and partitions.
  • Changing door and window openings, especially in load-bearing walls.
  • Moving the bathroom or kitchen, affecting wet zones and pipework.
  • Changes to building services: heating, ventilation, sewage.
  • Merging rooms, including joining a balcony to a room.
  • Work affecting the building's facade.

What does not need approval

Cosmetic repairs: finishing, new floor coverings, windows in the same openings, plumbing and furniture in the same places, moving sockets and appliances within the apartment.

What will not be allowed at all

  • Interfering with load-bearing structures in a way that weakens the building.
  • Moving wet zones above the living rooms of the neighbours below.
  • Removing or blocking ventilation shafts.
  • Changes that worsen neighbours' living conditions or breach fire safety rules.
  • Annexing common property of the building, such as part of the stairwell or technical rooms.

The approval procedure

The general logic is:

  • Design. Prepared by an organization licensed for it. Work affecting the structure requires a technical opinion on whether it is permissible.
  • Approval by the authorized local government body.
  • Carrying out the work according to the approved design.
  • Acceptance and updating the Cadastre: the technical plan of the property is updated (how the Cadastre works).

The fourth step is the one most often skipped: the work was approved and done, but the documents were never updated. For a future deal, that is the same as having no approval.

If the alterations have already been made

Retroactive legalization is possible if the work is permissible in principle. The procedure is similar: a technical opinion on the safety of the changes, an application to the authorized body and an update of the Cadastre records.

If load-bearing structures were affected in an unacceptable way, the changes cannot be legalized and the apartment has to be restored to its original state.

Tip for sellers: sort this out before listing the property, not after you have found a buyer. The procedure takes time, and buyers are rarely willing to wait.

Tip for buyers: compare the actual layout with the plan in the documents during the viewing. It is part of checking an apartment before buying and takes five minutes.

Renovating a new-build apartment

If you plan changes right after buying, ask the developer what is permissible in that building and make the changes before the property is entered into the Cadastre, which is simpler. For planning a renovation, see renovation budget in Yerevan.
